The Approach to Large Estates when Contesting a Will
Some members of the community might have a knee jerk reaction to an applicant of means making a claim upon a large estate in respect of a contested will. The reaction could be one questioning why such a claim could be made.
The reality is that the legislation enables fairly well off applicants to make a claim upon a large estate if they are eligible and the will failed to adequately provide for the proper advancement in life.
In recent times there have been examples of applicants obtaining orders for provision in circumstances where they as applicants are considered to be wealthy. The focus of the court in such cases could be on the proper advancement of such applicants.
