Can You Sue For Defamation
There are a number of factors that may affect whether you can sue for defamation.
The first step is to work out if you have standing to sue. For instance a large company that has many employees may not be able to sue whilst an individual may be able to.
The next step is to work out who could be sued, and if that person can be properly identified. In some cases involving online defamation it may be necessary to take steps to identify the person perhaps by preliminary discovery (if necessary).
Finally, it must be clear that you can prove the elements of a defamation to the extent that you have reasonable prospects for success. Typically, to prove a defamation you need to show matters such as:-
- the person made the statement;
- the statement was defamatory;
- etc.
