De Facto Partner Applicants - Contested Wills

De facto partners are specifically recognised as eligible for the purposes of contesting wills if the will failed to adequately provide for them. This would include couples of different sexes, and also same sex couples.

To prove the existence of a de facto relationship the applicant could potentially rely on an entry in the : Relationships Register Act 2010 (NSW) or alternatively go about proving the existence of that relationship.

At the hearing the court will be interested to know if the de facto partners lived together as a couple since that is significant.
