Examples of Unfair Conduct (or Oppression)
Where a company's affairs are being conducted unfairly the minority shareholders will probably want to explore an oppression suit.
Unfairness in the relevant sense can take many forms and in decided cases some of the examples of oppressive conduct include: -
- where the management go about their business in a way that is wasteful;
- where a member is excluded from management contrary to the constitution;
- etc.
