Extensions of time - Contesting Wills
There are strict time limits from bringing a claim for family provision so that the estate can be properly administered without the need to deal with late claims. However, sometimes an applicant cannot bring a claim within 12 months from the date of date and it may then be necessary to seek an extension of time.
An application to extend time for the purposes of contesting a will normally considers a number of factors including: -
- the length of the delay and the reason for it;
- the prejudice to beneficiaries; and
- the strength of the applicant's case.
