The family farm in contested wills
When there is a family farm in a contested will case the issue can be more complicated especially if the parties (or court) is determined to preserve the family farm. Traditionally, there was a tendency to leave the farm to the oldest son (who often worked on the property) whilst other siblings such as the daughters may have been excluded.
There are ways to make a family provision order for siblings who are eligible and who have not been adequately provided for. To discuss the options for making provision when a will is contested and a rural property is involved contact us to schedule a conference.
