Sometimes a mortgage or guarantee is unjust in the circumstances that it was made. Obviously, a party affected by a contract in such circumstances will want to know how they can go about getting out of an unjust contract.
Typically, there are a number of requirements before the court will exercise its jurisdiction under the Contracts Review Legislation. For instance it must be a personal (and not a business contract) and there must be circumstances that make the contract unjust e.g. age, education, background or knowledge of the other party.
The court has a wide range of relief that it can offer by declaring a contract void, varying it and so on.
