Guardianship Tribunal applications 

At the hearing of a Guardianship Tribunal application there will usually be three members: a legal person, a professional person and a community member. The tribunal is obliged to consider the general principles set out in the relevant legislation which focus on the welfare and interests of persons with disabilities.

Such applications are typically brought by: –

  • the person with a disability
  • the Public Guardian
  • someone who is genuinely concerned such as a family member or friend.

The application must set out the reasons why a particular order needs to be made so as to explain why: –

  • for a guardianship order why the person is incapable of managing his/her person
  • for a financial management order why the person is incapable of managing his/her financial affairs.

The tribunal will also be interested in hearing from the affected person and relevant family members.
