Home Building Disputes

Most home building disputes essentially involve a question about whether the other party should: -

  • pay money;
  • not pay money;
  • do specified work (or services); or
  • perform / refrain from doing something. 

Despite the apparent simplicity of the orders the Home Building Act (and regulations to it) are quite complex given the extensive amendments that have been made.

  • if the insurance policy is triggered making a claim upon the insurer;
  • corresponding with the contractor with a view to give him an opportunity to remedy the defects;
  • lodging a complaint with NSW Fair Trading, and assist with any investigation that follows;
  • taking the matter further if NSW Fair Trading cannot resolve it or if the builder fails to comply with a rectification order;
  • applying for a money order (or work order) at NCAT, Home Building Division for breach of any statutory warranties;
  • brief an expert to prepare a building defects report;
  • take the matter to the District or Supreme Court where the quantum exceeds $500,000.
