Misleading or deceptive representations can occur in a number of context that include an employment relationship or during business activities.
Misleading Re: Employment ~ s 31
Section 31 of the ACL prohibits a person from misleading others about matters pertaining to employment such as: –
a) it’s availability;
b) the nature of the employment;
c) the terms and conditions attached to the employment.
Examples of Misleading Conduct in the Employment Context
One of the cases in this context found a person engaged in misleading conduct when they represented to the buyers of second-hand trucks they would have employment opportunities from nominated sources.
Misleading Contuct Re: Business Activities ~ s 37 ACL
A similar prohibition exists against misleading people about the profitability and risks associated with a business activity that can be carried out from home.
Additionally,a person is not to mislead another about business activities that requires the other person to either work or invest money.
