Entering into a contract when you are mistaken

When parties labour under a mistake when they enter into a contract they will be interested to know if it can be rescinded.

There are different kinds of mistake in that they can both be mistaken about the same matter (aka common mistake), or they can both be mistaken about different things (mutual mistake) or only one of them can be mistaken (unilateral mistake).

Given that there are conflicting views about the operation and application of mistake the area is somewhat vexed. The uncertainties may or may not end up supporting your case.

To find out how common mistake, mutual mistake and unilateral mistake applies to your case contact us to schedule a conference.
