The Process For Appointing A Receiver

The application to appoint a receiver can be made at various stages. Sometimes, where there is urgency the application will be made without notice but more commonly on notice to the other side. 

A number of steps need to be taken before the application is made such as deciding on who will be the receiver. There is also a need to obtain appropriate consents from the receiver and to file an affidavit as to fitness. 

The affidavit in support of the application needs to address specific matters including: -

  • the criteria for appointment;
  • the nature of the property;
  • etc.
