The Remedy of Account
Sometimes it is not appropriate to seek damages. That is particularly so when the other side has "gained" something more valuable than what the plaintiff has "lost" especially for breaches of an equitable obligation.
Because the remedy of account is very expensive it is important to get advice about the options for making it less expensive.
In some cases it is not enough just to get the taking of accounts since the entries may need to be scrutinised in which case there may also need to be an order for an "inquiry"
Moreover, typically a plaintiff will want to test the accuracy of the accounts by cross-examining the defendant.
