Remove A Caveat
If you are the registered owner of a property and someone has lodged a caveat that you need to remove then you will have a number of options.
Some of the ways to remove a caveat include: -
- getting the consent of the caveator;
- through a lapsing notice;
- by approaching the court.
If an urgent application needs to be made to the court for the removal of a summons (a.k.a. withdrawal of a caveat) then we can assist you by advising you on the applicable principles, the procedure to be adopted and the preparation of evidence.
Alternatively, if you are faced with an application to remove your caveat then we can advise you on how to oppose the application for the removal of a caveat. That may also involve bringing proceedings to protect your legal estate / interest in the property as the court will be interested in seeing the real issues determined.
Contact us to book a conference to discuss how to remove or extend caveats (or opposing such an application).
