When to ask the court (Mareva orders)
Much will depend upon the circumstances of the case. The court rules will in appropriate cases allow an application to be made before, during or after a court proceeding.
It is essential that the jurisdiction is engaged and that the plaintiff is in a position to make out the evidentiary requirements.
Once it is clear that a defendant is taking steps to destroy the fruits of any judgement that might be obtained the plaintiff should act quickly otherwise an application may be pointless or defeated.
