What is an Application for Guardianship?

An application for guardianship is a legal process where a person (the applicant) seeks an order from NSW Civil and Administrative Tribunal (NCAT) that a guardian be appointed to the person about whom the application is made. This is sometimes needed when the informal arrangements do not work, and where the person is unable to make important decisions about their person due to reasons such as a medical condition, age, or other factors.

 

This template essentially populates the information sought by NCAT in its Guardianship application form, and it also provides a:

  • checklist for briging the application for guardianshop with NCAT
  • a script that you can use to discuss the nature of the application with the person concerned
  • a draft letter to the medical doctor asking for an opinion regarding the person concerned
  • a draft letter to a social worked asking for an opinion regarding the person concerned
  • a draft letter to an occupational therapist for an opinion regarding the person concerned
  • a draft letter to a referee, if you want to be the guarding about your fitness for that role
  • a draft copy of the application for guardianship that you will lodge with NCAT.
